Conditions of Business


The basis on which requests are reviewed, quotations issued and work performed.

What Is Governed

The terms below govern requests submitted through cmmcalibrationcleveland.com, the quotations issued in response, and the performance of CMM Calibration and Repair and related work arranged through this site. Either a request submitted or a quotation accepted is acceptance of them. Where a signed supply agreement or agreed purchase-order terms are already in place, those take precedence over these terms to the extent of any conflict.

Review of Requests and Contracts

Quotations follow a review; they never precede one. The review confirms that the requirement is stated clearly and understood, that the method, range and measurement capability needed are available, and that the laboratory selected to carry out the work is competent to perform it.

Statements of conformity require the decision rule to be agreed in writing before work begins, together with the specification the item is to be assessed against. When a requirement changes after acceptance the review is repeated, and the change is confirmed to the customer before work continues. What cannot be met as specified is declined, or returned with an alternative scope — accepting it and quietly reducing it is not an option.

External Providers and Payment

Every technical service described on this site is externally provided. Cleveland CMM Calibration and Repair operates cmmcalibrationcleveland.com as a marketing and referral website; it is not itself a calibration laboratory and does not perform the measurements itself. Each request submitted through this site is passed to an external laboratory that holds its own accreditation, operates its own quality management system, and issues its own certificates and reports.

Four criteria decide which provider receives the work: current accreditation and the scope of it, demonstrated capability for the specific measurement requested, traceability arrangements, and record of on-time delivery. Performance against them is monitored on an ongoing basis, and a provider that ceases to meet them is not used. Where a customer instructs that work must not be subcontracted, that instruction is honored or the request is declined.

For that introduction the operator of this website is paid — a referral fee, a fixed fee for the use of this website, or a commission on work that is placed. It is stated plainly so that the commercial relationship behind the site is not left implicit. The price quoted is not altered by it, and it gives the operator no role in performing, approving or certifying any measurement.

How Quotations Work

Quotations are written documents, valid for thirty (30) days from the date of issue unless a different period appears on the quotation. Each is built from what the request supplied: the item description, the quantity, the measurement points, the tolerances and the turnaround.

Every quotation rests on the item being as described. Additional channels, a wider range, damage, or a condition needing repair before measurement is possible all change that, and work is held while a revised quotation is issued. It proceeds once the revision is approved in writing.

Turnaround

Turnaround is stated in business days. It runs from whichever comes later: receipt of the item, or receipt of written approval to proceed. Where capacity allows, expedited handling is available and is quoted separately. Every commitment is given in good faith against current capacity, and a commitment that cannot be met is notified as soon as the delay is known, with a revised date.

Shipping, Handling and Risk

Packaging adequate for transit is the customer's responsibility, along with any accessories, fixtures, cables or software the work needs. Transit risk runs with the customer in both directions unless carriage has been arranged and charged on the quotation.

Anything unsafe, contaminated, or outside the condition accepted at review goes back unworked, and the reason is stated. Completed items sit at the customer's risk after the collection or despatch period agreed on the quotation.

Payment Terms

Payment in full is due before certificates and items are released, except where a credit account has been approved in advance; approved accounts are billed net thirty (30) days from the date of invoice.

Taxes, duties and carriage are excluded from the quoted price unless the quotation states otherwise. An overdue balance may accrue interest at the lower of one and one-half percent (1.5%) per month or the maximum permitted by law, and work on an overdue account may be suspended until it is settled.

Certificates and Their Reproduction

Certificates and reports are issued by the laboratory that performed the work and remain that laboratory's technical record. On payment in full, the customer holds an unrestricted right to keep, copy and use the certificate for its own quality, audit and regulatory purposes.

Certificates are issued as a complete document and may be reproduced only in full. Partial reproduction requires written approval. Copies are retained for the period stated in the performing laboratory's records policy and can be reissued against the original certificate number.

Confidential Information

Confidentiality attaches to information obtained or created in the course of a request, including drawings, specifications, tolerances, measurement results and the existence of the engagement itself. It is available to the personnel and providers who need it to complete the work, to a body to which disclosure is required by law, and to an accreditation body exercising its rights of access. The customer is notified of a disclosure the law required, unless that notification is itself prohibited.

Limits of Liability

Reasonable skill and care are applied to the work, in accordance with the methods and standards stated on the quotation and on the resulting certificate. Where work is shown to be defective, the customer elects the remedy: re-performance of the affected work, or a refund of the amount paid for it.

Total liability arising out of any engagement is limited, to the maximum extent permitted by law, to the amount paid for the work giving rise to the claim. No liability is accepted for loss of profit, loss of production, loss of contract, or any indirect or consequential loss. Liability that cannot be limited by law is not limited by anything in these terms.

Governing Law and Changes

Governing law is that of Ohio, applied without regard to conflict-of-law principles, and the courts of that jurisdiction hear any claim unless a different forum has been agreed in writing.
